Nirbhaya's case: Delhi court postpones the execution to February!

The Delhi court has, on Friday, issued a fresh death warrant for all the four convicts of the Nirbhaya case in which the court has directed to execute the convicts on February 1st, 2020 at 6 am in Tihar prison complex. The verdict of postponing the execution comes hours after the President had rejected the mercy plea filed by one of the convicts. 

After having negative responses from the Apex court and the President, the convicts have no legal remedy in their bank other than stepping on the gallows. It has been speculated that the execution would be postponed with accord to the 14 days notice period after the rejection of the mercy petition and the reports say that the Delhi court had rescheduled the date of the execution based on the request made by the Tihar jail authorities.

 

The execution date has been postponed at the crucial time when Nirbhaya's mother Asha Devi has, on Friday, blamed the BJP and AAP parties over playing politics by deliberately postponing the execution of the perpetrators.

While speaking to the ANI News agency about the exchanges of accusations between BJP and AAP, Asha Devi said that "It has been seven years and we didn't get justice" and by stating that the government has failed to understand the pain, she accused the Central ruling BJP and Delhi ruling AAP of playing politics over the death of Nirbhaya and added that the political fight between the parties has been deliberately postponing the execution of the convicts.

Her allegation has come a day after the BJP and AAP governments had engaged with heated exchanges where on Thursday, BJP has claimed that the AAP's government in Delhi is responsible for causing a delay in executing the Nirbhaya case convicts and by rebutting the accusation imposed by the BJP, AAP's senior leader and Delhi's Deputy Chief Minister Manish Sisodia lashed the BJP government and asked the Center to give the control of Delhi police to the Delhi government along with the law and order responsibility for the two days and the Delhi government will execute the convicts.

Nirbhaya's mother Asha Devi has sent her demand to Prime Minister Narendra Modi towards ensuring that the four convicts are hanged on January 22nd and Justice for Nirbhaya is served. The reports have earlier cited that the execution will less likely to carry out on January 22nd as the convicts were given with 14 days of notice period from the day when the mercy pleas were rejected.

With the view of getting acquitted from the death penalty, one of the convicts Mukesh Singh had tabled his mercy plea before the Lieutenant Governor of Delhi and the President of India and earlier, Mukesh Singh had reported to the Delhi High Court and by citing his pending mercy petition, he asked the court to provide him minimum 14 days notice between the dismissal of his mercy plea and the date of execution. On Friday, with accord to the recommendation of the Union Home Ministry, President Ram Nath Kovind had rejected his mercy plea, exactly five days before the previous date of execution.
